Adam C. Flury

 

Adam C. Flury is a Partner at Berman Flury and has focused his practice on representing community associations as both corporate counsel as well as construction defect litigation counsel since 2005. Mr. Flury is a member of the Community Associations Institute (CAI) and the San Diego County Bar Association.

Mr. Flury graduated from San Diego State University in 2000 with a Bachelor of Arts in Political Science and attended California Western School of Law obtaining a Juris Doctor in 2004.

Over the course of his career Mr. Flury has tried numerous homeowner association cases, both corporate and construction defect related, to successful verdict. In his practice, Mr. Flury strives to reach the best resolution possible for his clients in the most time and cost-effective manner as possible. He understands that litigation and the disputes his clients are involved in can be stressful and often impact not only the associations he represents but also the individual members of the community. It is for that reason Mr. Flury believes client involvement and interaction when disputes do arise is imperative to reaching a result his client is pleased with. The goal is always to keep clients out of litigation, but to also be prepared to litigate if needed.  

Mr. Flury’s practice includes all aspects of Community Association representation including, but not limited to:

  • Amending and/or restating association governing documents

  • Association board training relating to fiduciary obligations, hot topics in the industry and new laws

  • Providing legal counsel to association boards relating to issues and disputes that arise in their respective communities

  • Assisting with and participating in Internal Dispute Resolutions and Alternative Dispute Resolutions

  • Enforcement of association rules and governing documents

  • Reviewing and drafting third party vendor contracts

  • Assessment collection

  • Litigation relating to both enforcement and collection actions

  • Assisting Boards in responding to Department of Fair Employment and Housing (DFEH) complaints

  • Assisting Boards in responding to requests for reasonable accommodations and modifications

  • Assisting Boards with handling capital improvement projects and special assessments
